Construction accident can prompt injured worker claim

Risk is an important consideration when a person decides to work in the California construction industry. Due to the types of environments to which construction workers are generally exposed, they must take extra care to maintain proper safety precautions. Much of this has to do with the large and heavy machinery construction workers typically deal with on a daily basis. An accident involving heavy machinery often results in an injured worker claim.

Unfortunately, one recent construction accident ended up being fatal and may now result in workers' compensation death benefits being sought by the victim's family. The incident happened at a construction site in another state at approximately 7:45 a.m. A 33-year-old man was killed. Authorities have released little information regarding the details of the accident. Reportedly, the victim was pronounced dead at the scene of the accident.

Despite the lack of details released, many have noted a certain amount of attention being paid to a particular piece of machinery which may have had something to do with the fatal incident. That particular machine has now been blocked off by authorities with a tarp. The Occupational Health and Safety Administration as well as other safety authorities are currently investigating to determine the possible cause of the accident.

The employer will now have to deal with the possibility of death benefits being awarded following an injured worker claim if the family of the decedent indeed decides to file. However, just like similar workplace accidents in California, the employer may have to deal with safety violations as well. The employer will likely benefit by becoming aware of the applicable workplace safety and compensation laws in order to take the necessary legal actions to protect business and financial interests.
