California woman sentenced for false injured worker claim

Workers’ compensation fraud can be damaging to an employer financially and professionally. A California woman who worked for the county was recently sentenced for collecting benefits from a false injured worker claim she filed. A business owner who has suffered from a false injured worker claim may choose to seek repayment from the dishonest party and halt all medical benefits.

The situation began when the employee claimed to have severely injured her back while at work. While she remained on complete disability leave from her job, she purportedly requested home health care for assistance due to her extreme condition. As the woman continued to collect workers’ compensation benefits for her claimed damages, a team of investigators began to review her case.

They were able to capture the woman on video walking and bending at numerous business locations that she owned during the time she claimed disability. Reports state that the video reveals that the employee did not seem to suffer from back disability as she completed work duties. After being held responsible, the courts determined that the woman should provide $54,773 in restitution to her employer in addition to serving four months behind bars.

The amount of time an employee is away from work due to an injured worker claim can impact the cost a company incurs. This can be increased when a temporary or permanent disability is falsified. In the event that a California business suspects workers’ compensation fraud, it may take the necessary precautions to ensure that the dishonesty is stopped and that it receives the restitution to which it may be entitled.
