Why it is important to properly document workers' injuries

It may go without saying, but the human brain is one of nature’s wonders. It is one of the most complex structures known to man because of how it can harness so many memories and images, while controlling and initiating emotions such as happiness, compassion and sadness.

At the same time, the brain must be protected. It is no wonder that it is encased in a hard skull and protected by additional fluids and membranes. Nevertheless, the brain is vulnerable and can be injured by blunt force trauma (i.e. blows to the head). According to the Centers for Disease Control and Prevention, 2.5 million Americans will go to the emergency room this year to receive treatment for traumatic brain injuries. A majority of these injuries will be suffered through falls, as they are the leading cause of TBI.

With so many injuries suffered through falls, it is likely that some of these falls will occur in the workplace. When this happens, it is imperative that the employer quickly and thoroughly document the event, as well as the steps taken directly after the accident. These steps are critical in defending workers’ compensation claims, as well as in protecting the employer against possible litigation.

Indeed, workers’ comp is designed to mitigate legal action and provide benefits for injured workers as they recover, but proper documentation serves as detailed protection for employers in the event the worker believes that the employer was grossly negligent in keeping the workplace safe. If you have questions about what steps to take, an experienced workers’ compensation defense attorney can help.
