Sentencing for California woman's scheme to defraud employers

A person's ability to defraud employers can be expensive and damaging to an employer who has been providing benefits. Business owners who suspect an employee or a relative of an employee of taking advantage of the workers' compensation system may choose to investigate the situation. A California woman was recently found guilty and sentenced for an ongoing scheme to defraud employers by collecting workers' comp benefits assigned to her late father.

Although the suggested sentence for her crime was one year in jail, records indicate that the U.S. district judge chose to use the woman as an example and almost doubled her jail time. The woman received a sentence of one year and nine months. Reports indicate that the California woman apologized and confessed to collecting the workers' compensation benefits meant for her late father for over 20 years.

The woman, a mother of six, claims she began to collect the benefits illegally after she lost her home and had to live out of her vehicle. The ongoing fraudulent activity was discovered following an audit of existing long-term disability benefits conducted by a different state's department of labor. The audit revealed that benefits of close to $400,000 were collected. The FBI reported their surprise at the length of time the woman was able to defraud her late father's employer of workers' comp benefits.

Reports indicate that the FBI will continue to fully investigate situations that defraud employers. People who commit workers' compensation fraud do it at the expense of taxpayers. California employers who have been victim to fraudulent activity may choose to pursue justice and take the necessary legal measures to ensure their businesses are protected.
