Chiropractor sentenced for workers' compensation fraud

A California business owner who is accused of workers' compensation fraud may feel a myriad of emotions as they face a gruesome investigation. If an employer is found guilty, they may choose to seek help in minimizing fines and protecting business assets as best as possible. A chiropractor was recently investigated, convicted and sentenced for workers' compensation fraud for certain practices in his place of business.

The chiropractor who owned and ran his treatment facility was accused of creating and furnishing fraudulent treatment records to support the fraudulent workers' compensation claims he was submitting. Authorities from the state department that investigated the workers' compensation fraud claim to have aggressively sought out this potential perpetrator and uncover the compensation received from fraudulent billing. The special investigations unit began the investigation following allegations they purportedly received about the chiropractor's fraudulent activities.

The investigations unit created an undercover operation in which they interacted with the chiropractor under the pretense of being an injured worker and gained access without suspicion. They were able to procure and enforce a search warrant while at the clinic, and collect the information necessary to move forward with the case. In court, the accused man pleaded guilty to the first-degree misdemeanor of workers' compensation fraud as determined in his plea agreement.

His sentencing included a repayment of investigation expenses and restitution to the state workers' compensation department for over $69,000. In addition, his jail term was suspended for five years of community service. An employer in California that is discovered to be involved in workers' compensation fraud may look into all possible options to create a strong defense and decrease potential court sentencing.
