Officer's fraudulent workers' compensation claims

California police officers are constantly watched and looked to for guidance, honesty and integrity by the people they live and work around. An officer, or any company employee, who is dishonest can risk the safety and trust of the community and department. A ruling in a police officer's fraudulent workers' compensation claims recently confronted that dishonesty.

Authorities' report that the man previously employed as a California police officer was court ordered to reimburse the state over $14,000 in damages in a lawsuit for fraudulent workers' compensation claims that ultimately became insurance fraud. He plead no contest to the felony, and was additionally assigned two years of probation. The fraudulent worker' compensation claim was filed after the California police officer purportedly injured a shoulder during an arrest. This prompted his third leave for disability, and raised a red flag in the department.

Records reveal that authorities found his disability pattern suspicious. During the investigation, the courts retained evidence that contradicted the officer's claim of disability which was further supported by medical examination. Existing damage of his shoulder was not detected upon further analysis. He was then investigated for making false statements, when questioned about physical activity.

The officer was discharged for being in violation of the Code of Ethics for police officers as well as dishonesty. Following the proceedings, the courts released a statement saying that no one has immunity from the law when fraud is exercised. The California Department of Insurance has discovered and prosecuted 1,332 fraudulent workers' compensation claims in the past year alone. An employer who suspects a situation similar to the recent police officer's fraudulent workers' compensation claims may seek legal guidance in pursuing an investigation.
