Failure to maintain a safe working environment can wreak havoc

Not all jobs in California are considered to be dangerous. There are those who work in environments that could be considered relatively safe. However, the truth of the matter is almost any job, anywhere, can result in devastating injury or even death. Any failure to maintain a safe working environment can result in tragic consequences. Recently, an employee for John Deere passed away from injuries sustained in a forklift accident.

Most of the details of the incident remain unreported. However, a spokesperson for John Deere said that the company's primary concern is the employee and his family. A company representative remained with the injured man's family at the hospital round-the-clock after the accident. It is safe to assume both the company and the man's family are suffering the pain of a devastating loss.

The 54-year-old Service Parts Operation supervisor passed away at the hospital where he was undergoing treatment after being struck by a forklift. The man was working third shift hours at the time of the tragic accident. At this point, there's no indication as to whether or not a failure to maintain a safe working environment contributed to the incident.

Because this tragic accident took place while the victim was on the job, his family will likely be eligible to file a claim for workers' compensation death benefits There's no indication as to whether or not OSHA will investigate a possible failure to maintain a safe working environment as a result of the accident, but an investigation would not likely be required in order to secure the family's eligibility for workers compensation. In the event of an employee's death, his or her family may be able to seek compensation and use the money to recoup losses associated with funeral expenses and the loss of family income. Unfortunately, workers' compensation claims, in California and elsewhere, can be complicated and it is often necessary for families to seek assistance through the process.
