19,000 private sector employers to be sent OSHA survey

In the world of workers' compensation defense, it is not uncommon to see a serious work injury/work comp claim go hand-in-hand with a violation from the Occupational Safety and Health Administration (OSHA). As such, it is also not uncommon to hear employers voice their firm objections over the OSHA violation, claiming that they were unaware of a potential problem or that OSHA regulations are unduly restrictive.

Interestingly, it now appears as if employers are finally going to be able to have some say in the shaping of future OSHA rules/regulations, compliance assistance and even outreach efforts.

This week, OSHA officials announced the launch of a comprehensive survey - sent to 19,000 private employers of all sizes throughout the nation - to learn more about their health management practices and approaches to work safety.

Some of the questions covered by the OSHA survey include:

  • Who is responsible for managing safety programs at the workplace?
  • What type of workplace hazards/dangers are typically encountered by employees at the workplace?
  • Are annual safety inspections of the workplace performed and, if so, how often are they performed?
  • Does the workplace have an established safety management system/program to prevent work injuries?

It is important to note that participation in the survey is both voluntary and anonymous. Furthermore, all responses will be kept confidential and cannot be used as the basis for future enforcement actions by OSHA.

A paper copy of the survey, entitled "Baseline Survey of Safety and Health Practices," will be mailed to employers and can be returned to the Eastern Research Group (ERG), an independent contractor handling the data collection. Participants also have the option of filling out the survey online.
