California employer defense needed when workers lie about injury

California employers often suffer many business and legal complications when workers are not forthcoming about supposed on-the-job injuries. Many incidents include workers filing claims, later to be discovered as having falsified documents in order seek personal financial gain. A strong employer defense is often crucial toward fighting against such fraud in the workplace.

The more evidence an employer can provide regarding a suspected fake work injury, the better chances may be that a claim will be denied. Although, an employer cannot force an insurance agency to deny an allegedly falsified claim, there is legal recourse available to fight against such fraud in the workplace. In most situations, employers will want to do all they can to avoid increased premiums and financial losses further down the line.

One thing that may alert an employer to the possibility of work injury fraud is the absence of details in reporting the injury following a supposed accident.  If an employee's recounting of the incident remains vague or details do not add up, an employer may have reason to believe that something is awry with the claim. Many times, claimants will make statements to others revealing the truth of a situation that can then serve as evidence against them in court.

For instance, if a worker tells witnesses that he or she is not hurt after an accident has happened but then files a claim and stops coming to work due to a supposed injury, the statements made at the time of the accident may be admissible as evidence against apparent fraud. Such situations are often complex and building a strong employer defense is crucial toward protecting one's business interests and obtaining justice. A California workers' compensation attorney would be able to guide an employer through the appropriate legal process of fighting against a particular claim.
