Workers' compensation fraud ongoing problem in California

Employers must keep close eyes on their companies in order to prevent employee schemes that may cause them to suffer substantial financial losses. Workers' compensation fraud is problematic in many areas, including various workplaces in California. Fortunately, an employer has the right to take legal action when employee fraud is suspected.

An experienced workers' compensation defense attorney is able to prepare aggressive representation on behalf of any employer who suspects that a worker has filed a fraudulent claim. Often, such situations include the exaggeration of a work-related injury or a claim that an injury occurred on the job, when, in fact, it happened outside the workplace. Two people were recently charged in an alleged scheme against the federal government. The man and woman are accused of mail fraud and stealing government property. Apparently, they misrepresented an on-the-job injury to the Social Security Administration and other entities.

The woman is said to have accompanied the man to various hearings. Evidence suggests that she filed various documents on his behalf, stating that his injury prevented him from driving or living without assistance. Authorities say there is video proof that shows the man driving, working out in a gym and shopping.

The court ruled that the pair deceived state and federal governments out of thousands of dollars. The man is scheduled to serve more than four years in prison, while the woman was placed on a three-year probation. Both must pay more than $27,000 in restitution to the Social Security Administration. Any employer in California who is facing similar workers' compensation fraud issues may retain legal assistance to request that the court hold those responsible legally accountable for their actions.
