Employer defense may be needed after worker dies in accident

The unexpected death of a worker is always an emotional experience for an employer. Not only is the loss of human life tragic and challenging to confront, the legal implications can also be quite difficult in California. When a worker dies, OSHA usually responds by investigating whether or not the employer may have violated safety regulations. If OSHA does cite an employer following an investigation, the company may want to begin formulating a good employer defense strategy.

This is what one company may be facing following a recent fatal industrial accident. The incident resulted in the death of one worker, according to the latest reports released to the public. Details have not been released regarding the cause of the accident, but rescue crews reported that they found the victim trapped underneath a piece of machinery when they arrived on the scene.

The victim was an adult male; however, authorities will not release the identity of the victim until the man's next of kin is notified. Rescue crews pronounced the worker dead at the scene of the incident. Along with OSHA, the local police are also investigating the incident. As of now, the police have not discovered any evidence that would lead them to believe any foul play had occurred.

OSHA will now be investigating to see if any safety violations played a role in causing the deadly workplace accident. If the regulatory agency decides this is the case, it can be financially damaging to the employer. Financial restitution can be a major problem for any employer facing OSHA citations for safety violations in California. In some cases, it may be best to launch an employer defense campaign through the proper legal channels.
