Possible OSHA violation: California worker dies, crushed by truck

California workplaces tend to vary in the level of risk that workers encounter while employed there. Some work places, such as a law office, might be safer than a construction site. However, even in seemingly safe environments accidents can happen. When a death or catastrophic accident happens at a workplace, often OSHA safety officials will arrive on scene following the incident to determine if an OSHA violation was present.

Recently, a 62-year-old man was killed while he was putting a new layer of asphalt down at a middle school in Berkley, California. The man was killed tragically when a giant truck rolled over the top of him. The source of information on this horrific accident were statements made by the California Division of Occupational Safety and Health.

According to an OSHA spokesperson, the man was rebuilding and resurfacing the running track used by the middle school in sporting events. A big-rig truck was parked on a slope near where he was working. The truck began to roll and it eventually rolled over the top of the man, crushing and killing him.

Employers take every precaution necessary to ensure the safety of their employees. They follow specific rules for creating a safe workplace to avoid an OSHA violation, and they do everything they can to make it even safer. In cases where an OSHA investigation reveals that employers failed in their duty to maintain a safe work environment, employees may be able to file a legal action for compensation on that point. Legal strategies can be employed to defend employers in the event of an OSHA violation. Such strategies can be used to limit an employer's liability and bring the best possible conclusion for both the injured worker and the employer involved in the accident.
